The charges are based on what the person was thinking when he committed the crime.  This is the first step down a dangerous road where someone will eventually be locked away on death row, convicted of murder, because he simply mumbled under his breath, "I'll kill you."&lt;/p&gt;&lt;p&gt;Remember the movie "Minority Report" with Tom Cruise?
